D-9/D-10 (Application for Authorization to Sign Final GMP Amendment)

The D-9 is an application for the district to sign the Final GMP Amendment with the project's Board-accepted contractor. Note that these forms closely resemble the D-7 application, except that they use actual board-approved contract amounts, not A/E estimates. The Final GMP Amendment cannot be signed until all D-9 requirements are fulfilled and a D-10 is issued. 

The D-9 must be submitted no more than 90 days from the D-8 issuance date unless an extension has been granted. 

A D-10 or D-10(1) must be issued before a PDB project may execute the Final GMP Amendment and begin building construction, including foundation work, pilings, or any other work associated with the building itself. For SCAP purposes, on a Progressive Design-Build project, the Final GMP Amendment establishes the Guaranteed Maximum Price (GMP) that OSPI will recognize for the construction phase of the project.

D-9 Extension Request and Approval 

If the project is coming in at more than 10 percent over the estimated total project cost established by the D-8, the district may request and extension of 90 extra days (for a total of 180 days from when the D-8 was issued) for submitting the D-9. This may be done only once per project.  

To request an extended 90 days for submitting the D-9, the district should write a letter addressing its regional coordinator before the first 90 days are up.   

D-9 Items Submission Checklist (For Progressive Design-Build Projects)

All D-Forms are submitted digitally through ICOS (See Chapter 2: Inventory and Condition of Schools). Please note that the item numbering may differ from your project in ICOS, as some items are contingent on the type of project (e.g., modernization, new construction, or replacement).

1 Copy of the final Guaranteed Maximum Price (GMP) Amendment without signatures This GMP amendment establishes the total construction-phase project cost that OSPI will recognize and should match the amount entered on the ICOS D-9 Form. This document must not be signed at this stage, as construction is not authorized until OSPI issues the D-10 or D-10(1)
2 School District board of directors' approval of the final GMP Amendment This may be provided in the form of meeting minutes or a resolution. In either case, it must include the Final GMP amount, which must match the amount identified in the Final GMP Amendment. If meeting minutes are provided, they must also state that the Final GMP amount was approved by the board. 
3 Statement of the specific amount of local and/or other disbursable funds available for funding this project This is a letter similar to what was submitted at D-5, but in this case the allotted amount for the project must be included and that amount must equal or exceed what is listed as the total project cost on the D-9. In addition, this letter must indicate that these funds are “disbursable.” 
4 School District board acceptance of the constructability review report and implementation This may be provided as a resolution or board meeting minutes. In either case, it must say that it was approved by the board.

The sample template in ICOS includes these in the same resolution. This is acceptable and most common.

Final Billings for: 

  • Educational specifications
  • Value engineering
  • Constructability review
  • Energy report (ELCCA)
  • DES Energy review fee
  • A/E fee calculation
  • Construction management fee calculation

The district must submit the final costs for these categories and provide documentation showing that the costs have been paid. If the Ed Specs and ELCCA were completed by the architect, they must be identified as separate line items and deducted from the A/E fee. (See GMP Amendment Template in this chapter). 

These costs must match the summary of costs listed at the top of the D-9 in ICOS. If the district is exempt from a particular cost, that cost should be entered as $0.

If the project is exempt from the ELCCA requirement, the PFEC and PFEC review by DES are not eligible for SCAP funding assistance and should therefore be entered as $0.
