D-9/D-10 (Application for Authorization to Sign MACC Agreement)

The D-9 is an application for the district to sign the Final MACC Agreement with the project's board-accepted contractor. These forms closely resemble the D-7 application, except that they use actual board-approved contract amounts rather than A/E estimates. The MACC Agreement cannot be signed until all D-9 requirements have been fulfilled and a D-10 or D-10(1) has been issued.

A D-10 or D-10(1) must be issued before a GC/CM project may execute the Final GMP Amendment, sign the MACC Agreement, or begin building construction, including foundation work, pilings, or other work associated with the building itself.

The D-9 must be submitted no more than 90 days from the D-8 issuance date unless an extension has been granted. 

D-9 Extension Request and Approval 

If the project is coming in at more than 10 percent of the estimated total project cost established by the D-8, then the district may request an extension of 90 extra days (for a total of 180 days from when the D-8 was issued) for submitting the D-9. The extension may be done only once per project, and OSPI approval is required.

To request an extended 90 days for submitting the D-9, the district should write a letter addressing its regional coordinator before the first 90 days are up.   

D-9 Items Submission Checklist (For GC/CM Projects)

All D-Forms are submitted digitally through ICOS (See Chapter 2: Inventory and Condition of Schools)

1 Copy of the MACC agreement without signatures This document must not be signed at this stage, as construction is not authorized until OSPI issues the D-10 or D-10(1)
3 School District board of directors' approval of the negotiated Maximum Allowable Construction Cost (MACC) This may be provided in the form of meeting minutes or a resolution. In either case, it must identify the approved MACC amount. 
4 Name and address of the GC/CM  
5 Statement of the specific amount of local and/or other disbursable funds available for funding this project This is a letter similar to what was submitted at D-5, but in this case the allotted amount for the project must be included and that amount must equal or exceed what is listed as the total project cost on the D-9. In addition, this letter must indicate that these funds are “disbursable.” 
6 School District board acceptance of the constructability review report and implementation This can be submitted as a resolution or board meeting minutes. In both cases, it must say that it has been approved.

The sample template in ICOS includes these in the same resolution. This is acceptable and most common.

Final Billings for:

  • Education Specifications
  • Value Engineering
  • Constructability Review
  • Energy Report (ELCCA)
  • DES Energy Report Review fee
  • A/E Fee Calculation
  • Construction Management Fee Calculation

The district must submit final costs for these categories and show that they have been paid. If Ed Specs and the ELCCA were conducted by the architect, they need to be shown as separate line items and backed out of the A/E fee. 

These costs need to match the summary of costs listed at the top of the D-9 in ICOS. If the district is exempt from a cost, that cost would be listed as $0. In the case that the project is exempt from having to do an ELCCA, the PFEC and PFEC review by DES are not eligible for SCAP funding assistance and should therefore be marked as $0.
