Nonpublic Agencies
Public schools are required to provide a free appropriate public education (FAPE) to students with disabilities ages 3–21 who are eligible for special education services. If a public school district determines that a student’s special education needs cannot by met by their resident school district, a Nonpublic Agency (NPA) is an entity authorized by OSPI under Chapter 28A.300 RCW to contract with a school district to provide placement for a student to receive a program of special education services. An approved NPA provides the student's special education and related services that are determined necessary for FAPE through the individualized education program (IEP) process.
Application Forms
- Initial NPA Application

An Initial NPA Application can only be submitted jointly by a sponsoring school district and a private (or out-of-state) entity seeking NPA status. A school district must recommend a private (or out-of-state) entity for approval to OSPI. The OSPI Special Education Division will review applications to ensure NPA requirements are met, and if so, grant Preliminary NPA Approval for placement and services. An entity will not be granted full NPA approval and added to the Approved NPA List until OSPI completes a follow-up onsite visit and review.
- Annual NPA Renewal Application

All entities currently on the approved NPA list should complete an annual renewal application by June 30th of each school year. At least one public school district with a student placed at an authorized NPA will be expected to complete an annual onsite visit and submit a report of that visit to OSPI.
- Three-Year NPA Reauthorization

OSPI will review all approved NPAs on a three-to-five-year cycle for continued authorization to provide special education and related services to students placed by a public school district. Reauthorization includes an onsite visit and review by OSPI to confirm NPA requirements continue to be met. All approved NPAs should complete an annual renewal application and contact OSPI if they believe the NPA is due for reauthorization.
